1. Introduction
These terms and conditions govern the use of services provided by ANCHOR Inclusion. Please read them carefully before engaging with our services.
ANCHOR Inclusion is the trading name of Early Help Support, registered in England and Wales.

By engaging with our services : whether directly, through a school, or via a referral : you agree to these terms. If you are booking on behalf of another person or organisation, you confirm that you have authority to do so and to bind that person or organisation to these terms.
The contracting party is the individual, school, or organisation that makes the booking or enters into a service agreement with ANCHOR Inclusion. This party is responsible for payment and for ensuring these terms are understood by any relevant participants.
2. Services Provided
ANCHOR Inclusion provides:

Early help support for children, young people, and families

Training and consultation for schools and education professionals

Guidance and coaching for parents and carers
-
Development of inclusive and trauma-informed approaches
-
Bespoke programmes and resources as agreed
Services may be delivered in person, online, or via written guidance, training materials, or recorded resources. The specific format will be confirmed at the point of booking.
Where a separate written agreement, service level agreement, or contract is in place between ANCHOR Inclusion and a client or commissioning organisation, that agreement will take precedence over these Terms & Conditions in the event of any inconsistency.
3. Nature of Services
Our services are educational, developmental, and supportive in nature. We work collaboratively with individuals, families, and professionals to build understanding, capacity, and practical strategies.
Our services are not a substitute for medical, clinical, therapeutic, or statutory services. Where it would be in the best interests of a child or family to seek additional or specialist support, we will say so and, where appropriate, assist with signposting.
If you are unsure whether our services are right for your situation, please contact us before booking. We will always be honest about what we can and cannot offer.
4. Bookings and Payment
Confirming a booking
All bookings must be confirmed in advance. A booking is confirmed when written confirmation has been issued by ANCHOR Inclusion. Verbal agreements do not constitute a confirmed booking.
Fees
Fees will be agreed in writing prior to service delivery. No charges will be applied that have not been agreed in advance. ANCHOR Inclusion reserves the right to review its fee structure periodically; any changes will not apply to confirmed bookings.
Payment terms
Unless otherwise agreed in writing, payment is due within 14 days of the invoice date. Invoices will be issued following service delivery or as agreed for multi-session arrangements.
For funded or school-commissioned services, payment terms will be specified in the relevant service agreement or purchase order.
Late payment
Where payment is not received by the due date, ANCHOR Inclusion reserves the right to:

Suspend further service delivery until the outstanding balance is settled

Charge statutory interest on overdue amounts in line with the Late Payment of Commercial Debts (Interest) Act 1998
We will always seek to resolve payment issues informally in the first instance.
5. Data Use Overview
Cancellation by the client
We ask that cancellations are made with as much notice as possible. The following terms apply:

More than 5 working days' notice : no charge
-
2 to 5 working days' notice : up to 50% of the agreed fee may be charged

Less than 48 hours' notice or non-attendance : up to 100% of the agreed fee may be charged
These thresholds may vary for training events, group programmes, or bespoke commissions, in which case specific terms will be agreed and confirmed in writing at the point of booking.
Cancellation by ANCHOR Inclusion
We will make every reasonable effort to deliver services as agreed. In the event that we need to cancel or reschedule, we will provide as much notice as possible and offer an alternative date at no additional cost.
Where a rescheduled date cannot be agreed, a full refund will be issued for any prepaid fees.
Rescheduling
Requests to reschedule will be accommodated where possible, subject to availability. Rescheduling requests made with less than 48 hours' notice may be treated as a cancellation under the terms above.
6. Third-Party Referrals and Commissioned Services
Where a school, organisation, or professional refers or commissions services on behalf of a family or individual, the following applies:

The referring or commissioning party is responsible for ensuring that appropriate consent has been obtained from the family or individual prior to referral

The commissioning party is responsible for payment of agreed fees unless otherwise specified in writing

ANCHOR Inclusion will treat the child or family as the end beneficiary of the service, and their wellbeing will be the primary consideration throughout
Where a family is referred by a third party but then engages directly with ANCHOR Inclusion, responsibility for payment and consent will be clarified in writing before services begin.
7. Consent and Children's Involvement
Where services involve a child or young person, appropriate consent must be in place before engagement begins.

For children under 13, consent from a parent or person with parental responsibility is required

For young people aged 13 and over, we will seek to ensure they are informed about and willing to engage with the support being offered, in line with their age and capacity

Where a school is the commissioning body, they are responsible for ensuring parental consent has been obtained in line with their own procedures, unless otherwise agreed
We will not engage directly with a child or young person without reasonable assurance that appropriate consent is in place. If consent is unclear or disputed, we will pause engagement until the matter is resolved.
8. Confidentiality
We respect confidentiality in all professional interactions. Information shared with us is treated with discretion and used only for the purposes for which it was shared.
Confidentiality may be overridden where:

there are safeguarding concerns about the safety or wellbeing of a child or individual
-
disclosure is required by law or a court order
-
information sharing is necessary to prevent serious harm
Where confidentiality needs to be broken, we will wherever possible inform the relevant party unless doing so would place someone at risk. Please see our Privacy Policy for further information on how personal data is handled.
9. Safeguarding
ANCHOR Inclusion operates in line with UK safeguarding legislation, statutory guidance, and best practice, including Working Together to Safeguard Children and the Children Act 1989 and 2004.
If concerns arise regarding the safety or wellbeing of a child or individual, appropriate safeguarding procedures will be followed without delay. This may include making a referral to children's services or other relevant agencies.
All staff and associates of ANCHOR Inclusion are expected to uphold safeguarding responsibilities at all times. Our safeguarding lead is S Asha, Early Help Practitioner.
10. Online and Remote Delivery
Where services are delivered online or remotely, the following additional terms apply:

Clients are responsible for ensuring they have a suitable device, internet connection, and private space for the session

Where a session cannot proceed due to technical failure on the client's side, it will be treated as a missed session under the cancellation terms in Section 5

Where a session cannot proceed due to technical failure on ANCHOR Inclusion's side, we will reschedule at no additional cost

Sessions will not be recorded by either party without prior written consent

Participants should ensure they are in a confidential setting appropriate to the nature of the session
11. Information Accuracy
We ask that clients share information that is accurate, relevant, and reasonably complete, as this directly affects our ability to provide appropriate support.
We recognise that sharing personal or sensitive information can be difficult, and we will always approach this with care and without judgement.
However, where key information has not been disclosed and this affects the quality or appropriateness of the support provided, ANCHOR Inclusion cannot be held responsible for any resulting limitations in the service.
12. Professional Boundaries and Scope
ANCHOR Inclusion delivers services within a clearly agreed scope, which will be outlined at the point of booking or in a service agreement. Services do not extend to:

Ongoing crisis support or emergency intervention

Clinical assessment, diagnosis, or therapeutic treatment

Acting as a statutory service or fulfilling statutory duties on behalf of another organisation
If a situation arises that falls outside our scope, we will be transparent about this and, where appropriate, signpost to other sources of support.
13. Intellectual Property
All materials produced and provided by ANCHOR Inclusion : including training content, written resources, frameworks, templates, and any bespoke materials : remain the intellectual property of ANCHOR Inclusion, Early Help Support, unless otherwise agreed in writing.
Materials provided to clients may be used for their intended personal or organisational purpose. They may not be:

Reproduced, copied, or adapted without prior written permission

Used beyond the purchasing organisation : internal use within the purchasing school or organisation is permitted unless otherwise agreed

Distributed to third parties or shared externally beyond the agreed scope
-
Used for commercial purposes or presented as the work of another party
Where bespoke materials are developed as part of a commission, ownership arrangements will be specified in the relevant service agreement.
14. Testimonials and Case Studies
We may occasionally share feedback, testimonials, or anonymised case examples to illustrate our work. We will only do so where:

Explicit consent has been given by the individual or organisation
-
Any information relating to children or families is fully anonymised and cannot be traced back to individuals
-
The use is in line with our Privacy Policy
You may be asked to provide a testimonial or participate in a case study. This is entirely voluntary and will never affect the quality of service you receive.
15. Force Majeure
ANCHOR Inclusion will not be in breach of these terms where a failure to deliver services is caused by circumstances beyond our reasonable control. This includes but is not limited to:

Illness or incapacity of the practitioner

Extreme weather or travel disruption
-
Technical failure affecting online delivery platforms
-
Public health emergencies or government-imposed restrictions
We will not be liable for any delay or failure in service delivery caused by such events.
In such circumstances, we will notify you as soon as reasonably possible and make every effort to reschedule. Where rescheduling is not possible, a proportionate refund will be offered.
16. Liability
ANCHOR Inclusion will provide all services with reasonable skill and care. However:

To the fullest extent permitted by law, we are not liable for indirect, consequential, or incidental loss arising from the use of our services

While we provide guidance based on professional knowledge and experience, outcomes may vary depending on individual circumstances and we cannot guarantee specific results

We are not responsible for decisions made by individuals, families, or organisations based on our guidance or recommendations
-
Our total liability in relation to any single service or booking is limited to the fee paid for that specific service
Nothing in these terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
17. Dispute Resolution
We hope that any concerns or disagreements can be resolved quickly and informally. If you have a concern about a service, please contact us in the first instance and we will do our best to address it promptly. Both parties will act in good faith to resolve any dispute.
If an informal resolution is not possible, both parties agree to attempt mediation before pursuing formal legal proceedings. Details of how to initiate this process are available on request.
This clause does not affect your statutory rights.
18. Data Protection
ANCHOR Inclusion processes personal data in accordance with UK GDPR and our Privacy Policy, which is available on our website and on request.
By engaging with our services, you acknowledge that personal data will be collected and used as described in our Privacy Policy. Where personal data is processed as part of service delivery, this is governed by our Privacy Policy and any relevant data sharing agreements.
Where services involve a child, data relating to that child will be handled with particular care in line with the ICO's Children's Code.
19. Changes to Services or Terms
ANCHOR Inclusion reserves the right to update these Terms & Conditions and to modify or withdraw services. Where changes are significant, we will provide reasonable notice : at least 14 days where practicable.
Continued engagement with our services following notification of changes constitutes acceptance of the updated terms. The current version of these terms will always be available on our website.
Any variation to these terms must be agreed in writing by both parties. Verbal agreements to vary these terms are not binding.
These Terms & Conditions, together with any written service agreement, constitute the entire agreement between the parties relating to the subject matter herein and supersede any prior discussions, representations, or understandings, whether written or verbal.
20. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes that cannot be resolved informally or through mediation will be subject to the exclusive jurisdiction of the courts of England and Wales.
